Work scope of BAT centre
Main functions :
 Development and revision of national BAT guidance;
 Information exchange on BAT incl. collecting information about
implementation of BAT guidance and investigation of emerging BAT
Depending on the technical expertise of IP authorities and the financial
setup of the BAT centre, there are additional functions:
1) Assessment and determining BAT for installations;
2) Developing of the whole IP applications for the industry;
3) Assessment of IP application for the IP authority.
These additional functions can be alternatively ensured by other expert
institutions or consultants.

Development of national BAT
guidance
• Development of BAT guidance is proposed through
Technical Working Groups (TWG) which consist of
industrial and environmental specialists and
representatives of environmental authorities.
• The draft BAT guidance is consulted with all relevant
stakeholders from industry concerned and
environmental authorities

Information exchange on BAT
collecting information about new BAT and
implementation of BAT guidance,
advise on interpretation of the BAT guidance and BAT
guidance revisions.
In the preparatory stage – recommended to organize
seminars for the relevant IP, RAA and inspection
authorities as well as for the industry to introduce the
concept of BAT, the scope of BAT guidance and BAT
assessment procedure

Technical support
A) For IP authorities in assessment or determining BAT
(in case permitting officers do not have sufficient technical
knowledge and experience)
B) For operators under IP regime in order to prepare
the whole IP application or BAT comparison part of
the application
(in case this would be carried out by the BAT centre, it shall be
on commercial basis)

Legal basis
The key functions or competencies of the BAT centre shall be
specified in the Law on environmental permitting in order to
allow for funding from state budget.
If the BAT centre is operated within the framework of the MoE
(e.g. organization subordinated to the Ministry) the functions or
competencies can be set as the functions of the Ministry in the
law.
The implementing legislation can specify: the content of the BAT
guidance, the procedure for preparation, compilation and
revision of BAT guidance or translation/adaptation of EU BREFs
incl. the formal approval and issuing of the guidance.

Options for BAT centre establishment
1. Appoint suitable existing organization which
expertise and experience allows to built on the
above mentioned BAT centre functions (e.g.
organization subordinated to the MoE or industrial R&D
institute which cover several industrial sectors);
2. Create a new organization which shall attract
relevant industry experts;
3. Establish a certification procedure for authorizing
external consultants, consulting companies or
research institutes in order to ensure operations of
the BAT centre function externally.

Management setup
• Schedule for BAT guidance development – linked
with overall implementation plan/phase in schedule
• BAT centre units shall work on the team cooperation
basis – to ensure flexible cooperation across all units
• The TWGs under the BAT guidance unit shall work
on project basis.
• Manuals and guidance for the regular activities shall
be developed.

Financing possibilities
The funding of BAT centre depends on its legal status.
Recommendation: to ensure funding from state budget for
developing national BAT guidance, information exchange on BAT and
providing technical support for IP authorities if relevant (in first few
years after introduction of the IP regime).
Financing options:
• 100 % financing from government/state budget,
• Partial funding from state budget and international funds (e.g.
EU, WB),
• Partial funding from state budget and industry sources.
In EU the industry associations are co-financing the BAT guidance
development as it allows them to influence the content.

Phases for BAT centre development
Summary of main tasks
• Preparatory phase – establishment of the centre, prepare
template/manual for BAT guidance and start with BAT
guidance preparation (1 year)
• Transitory implementation phase - preparation of BAT
guidance according to agreed schedule (4-8 years)
• Normal implementation phase – updating BAT guidance and
maintain BAT information exchange
