The work of International Consultant will consist of one stage.
100% of payment (lump sum) shall be made upon successful completion
of the assignment certified by UNDP/Project Manager

Direct supervisor:
University degree in Law
Academic degree, PhD, LLM or further professional training, as
well as professional diploma in the related field would be an
asset;
at least 7 years of professional activities in the area of intellectual
property law;
proven experience in the area of international treaties’ studies
on the issues related to the defined subject matter of the
research, as well as the studies of the national legislation
(including publications, participation in technical assistance
projects, work experience in international organizations,
research and teaching activity in similar areas)
experience in CIS countries’ legislation analysis would be an
asset );
English language proficiency
Knowledge of Russian language would be an asset.
knowledge of TRIPS and other baseline WTO agreements,
profound expertise in the area of international trade and
legislation;
strong interpersonal skills;
PC literacy (free use of MS Office applications and other
software necessary for the work in a project).

Project summary:
A joint project of UNDP Belarus and Ministry of Foreign Affairs in the Republic of Belarus "Assisting the
Government of the Republic of Belarus in accession to WTO by strengthening institutional capacity and
expertise" (2008-2012) aims to assist in conducting research to assess the possible implications of accession
of the Republic of Belarus to the WTO; strengthening national capacities on various aspects of the country's
accession to the WTO; raising public awareness about the WTO accession process.
The national implementation agency for the project is the Ministry of Foreign Affairs of the Republic of
Belarus. In the framework of the second phase of project implementation, analysis of the Belarusian
legislation for its compliance with the norms of baseline WTO Agreements will be done.
Objective:
Analysis of the legislation of the Republic of Belarus, including with regards to the foreign trade regime,
enforcement for compliance with WTO rules and recommendations on the changes to relevant regulations
The subject matter of the research is:
- compliance /non-compliance of legislative norms of the Republic of Belarus which are being analyzed with
the regulations of baseline WTO Agreements.
The research shall cover:
- current TRIPS and baseline WTO Agreements;
- legislation of the Republic of Belarus including the commitments taken by the Republic of Belarus under
agreements within the framework of the Customs Union of the Republic of Belarus, Republic of Kazakhstan
and the Russian Federation. The following things are to be analyzed within the legislation of the Republic of
Belarus: the main laws related to the subject matter of the regulations of baseline WTO Agreements in
question, resolutions of the President of the Republic of Belarus, Council of Ministers and republican
authorities.
The subject area of the research - “Trade-related aspects of intellectual property” shall include the
following issues:
- General provisions on the conditions of intellectual property protection in the baseline WTO Agreements;
- Legal regulation of the availability, scope and use of intellectual property rights;
- Legal enforcement of intellectual property.
Job responsibilities:
An international consultant, under the overall supervision of the Project Manager, UNDP Office in Belarus and
the National Project Coordinator, is responsible for the studies on the assessment of conformity of the
Belarusian legislation with the norms of baseline WTO Agreements and is expected to perform the following
tasks:
1)
To prepare an analytical note on the “Best International legal practice on harmonizing the national
legislation by Member-Countries with the baseline WTO Agreements” (within the subject area of the
research);
2) To analyze a list of normative legal acts of the Republic of Belarus, which have to be examined within
the subject area of the research and research the normative content of the TRIPS and other baseline
WTO Agreements and legislation the Republic of Belarus (following the list);
3) To conduct a secondary analysis of the balance of legal regulation, provided by the baseline WTO
agreements and legislation of the Republic of Belarus based on the information summary table
"Comparative regulation of intellectual property rights". If there are inconsistencies in the regulation to address them, to develop recommendations and prepare an analytical note "Comparative
regulation of intellectual property rights under the laws of the Republic of Belarus and the baseline
WTO agreements”.
4) To advise the Department of Foreign Trade of the Ministry of Foreign Affairs of the Republic of
Belarus on emerging legal issues of baseline WTO Agreements (within the research area of the
working group) and prepare a note containing Q&A (explanations) to the most important /frequently
asked questions on baseline WTO Agreements (within the subject area of the research ) for
subsequent publication and use as guidelines.
5) To develop a plan-schedule of conducting studies, reporting timeframe and provide the Project
Manager with the detailed information on the progress and results of the research activities.
Expected results (deliverables):
Deliverables consistent with the Department of Foreign Trade of the Ministry of Foreign Affairs of the Republic
of Belarus should be the following:

Analytical note on the ”Best International legal practice on harmonizing the national legislation by
Member-Countries with the baseline WTO Agreements” (within the subject area of the research, at
least 50,000 signs, English or Russian language);

Analytical Report "Comparative regulation of intellectual property rights under the laws of the
Republic of Belarus and the baseline WTO agreements " (at least 50,000 signs, English or Russian
language);
-
Analytical note with Q&A (explanations) on the most important/frequently asked questions on the
baseline WTO Agreement (within the research area of the working group, English or Russian
language).
The outputs have to be submitted to the Project Manager.
The outputs/deliverables are to be evaluated by UNDP in Belarus taking into account the opinion of the
Department of Foreign Trade of the MFA of the Republic of Belarus.
All rights on the research results belong to UNDP Belarus. The activities are being carried out in the regime of
restricted access to information about research results. An international consultant has no right to disclose in
subsequent the content and results of research carried out under this project*.
*This provision does not apply to the subject matter of activities, as well as information, dissemination of
which is jointly agreed in a written form with Ministry of Foreign Affairs and UNDP.
